Judge Shields Texas Clinics from the Group’s Abortion Lawsuits: NPR

AUSTIN, Texas-A state judge has so far protected Texas abortion clinics from group lawsuits against abortion under a new state abortion law in a narrow ruling Friday.

The temporary restraining order District Judge Maya Guerra Gamble in Austin on Friday in response to a request for planned parenting does not interfere with this provision. However, it protects clinics from whistleblower lawsuits by the nonprofit Texas Right to Life group, its legislative director, and 100 unidentified individuals.

A hearing on the preliminary request for a ban is scheduled for September 13.

The law, which went into effect on Wednesday, allows anyone anywhere to sue anyone involved in an abortion in which cardiac activity is detected in the embryo – as early as six weeks of pregnancy before most women even realize they are pregnant.

In petition filed late ThursdayPlanned parenting says about 85% to 90% of people who have an abortion in Texas are at least six weeks pregnant.

The order “offers protection to courageous health care providers and staff at planned parenting health centers throughout Texas, who have continued to provide care as best they can under the law, faced with surveillance, harassment, and threats from awake people who want to stop them,” said spokeswoman for planned parenting Helena Krasnoff ua statement.

However, the order will not deter the efforts of Texas Right to Life, said Elizabeth Graham, vice president of the group. In a statement, the group said: “We expect an impartial court to dismiss the planned parenting lawsuit. Until then, we will continue diligent efforts to ensure that the abortion industry fully follows” the new law.
